No: 61/26

Date: 15th July 2026

Three local men have today been convicted at the Supreme Court in connection with separate serious assaults that took place in June and October 2025.

In the first case, 22 year old Michael MARTIN, of Lime Kiln Steps, was sentenced to imprisonment for 3 years and 2 months, for the offence of Wounding with Intent to Cause Grievous Bodily Harm.

The case dates back to the 20th June 2025, when MARTIN violently assaulted another male at a private residence in Laguna Estate. The assault consisted of MARTIN striking the victim’s face repeatedly with his fists, causing the victim to fall to the ground where MARTIN forcefully stamped on the victim’s head/face with steel toe-capped work shoes. As a result of the assault, the victim sustained six different injuries to his head, including a laceration to the right side of his forehead that led to him losing consciousness.

Response Team Officers located and arrested MARTIN at a separate address shortly after the incident, on suspicion of ‘Wounding with Intent to cause Grievous Bodily Harm. The investigation was taken over by detectives from the RGP’s Criminal Investigation Department, who interviewed and subsequently charged MARTIN at the conclusion of their investigation.

On the 15th July 2026, MARTIN appeared before the Supreme Court, where he was sentenced and imprisoned for 3 years & 2 months.

In the second case, 22 year old Jotham SARDEÑA of Sir William Jackson Grove, and 21 year old Marcus AGUILERA of Willis’ Road, appeared today before the Supreme Court, and were both sentenced to imprisonment for 3 years and 2 months in connection with one count of “Causing Grievous Bodily Harm with Intent and one count each of Possession of a Controlled Class B drug.

The case dates back to the early hours of the 4th of October 2025, when the victim, an off-duty Royal Gibraltar Police Officer was heading home along the Ocean Village promenade. The victim crossed paths with a group of individuals and identified a female who had sustained an injury. Whist the victim began to contact Police to request assistance for this female, AGUILERA & SARDEÑA approached and began to antagonise him, immediately commencing a sustained and prolonged assault by delivering one punch to the victim’s face as he was turning away, which caused the victim to fall to the ground and hit the rear of his head on a tiled floor.

As the victim began to raise his head, SARDEÑA ran forward and kicked the victim in the right side of his face, as a result of which he lost consciousness. Both AGUILERA and SARDEÑA each kicked the victim at the top of his skull and on both sides of his head, and despite a third male person standing on the victim’s unconsciousness body and attempted to block these strikes and push SARDEÑA and AGUILERA away, both continued their attempts to kick the victim’s head.

The victim was assisted by members of the public, and remained unconscious for several minutes, at which points Response Team officers arrived at the scene and treated the victim until Paramedics arrived on scene. The victim was later assessed to have sustained 18 different injuries across his face, neck, head and upper torso area, as well as dental injuries requiring multiple appointments for corrective treatment.

Response Team Officers identified, located and arrested both suspects at a nearby location shortly after the incident. The investigation was taken over by detectives from the Criminal Investigation Department, who interviewed and subsequently charged both men at the conclusion of their investigation.

AGUILERA & SARDEÑA later pleaded guilty to the charges, and at the Supreme Court today, they were sentenced to imprisonment for 3 years and 2 months.
